WV Landowners Win Injunction to Bar Pipeline Surveyors

Earlier this week, Monroe County Circuit Court Robert Judge Irons issued an injunction barring surveyors for the proposed Mountain Valley Pipeline from entering the Brian and Doris McCurdy’s property without their consent. The judge said the builders of the proposed pipeline, which is a joint project of EQT Corp., NextEra Energy and others, had failed to establish that the pipeline project offered sufficient public use for West Virginians to justify entering private property without an owner’s permission for surveying, as required by state law. The McCurdys were represented pro-bono by lawyers with Appalachian Mountain Advocates.

This is an important win and a great first step in affirming a landowner’s right to say no to surveying on their land before “public use” is established.  You can read more about the case here and hereCongratulations and many thanks to the McCurdys and Appalachian Mountain Advocates for taking on these industry giants.
